Terms of Service

These terms apply to the use of Ventura, a Discord bot that backs up and restores Discord servers, and of this website. By adding Ventura to a server or using its commands, you agree to them. If you don't agree, don't add or use the bot.

Who provides Ventura#

The service#

• Ventura creates encrypted backups of Discord servers - manually with /backup create and automatically every day - and can compare, restore and repair a server from them. What exactly is backed up and restored, and the limits that apply, are described in the guide - in particular under Limits and pitfalls.
• Ventura is currently free of charge. We may change, limit or discontinue features at any time, e.g. to keep the service running for everyone.
• Backups are only kept for the periods described in the Privacy Policy - Ventura is no long-term archive.

Who may use Ventura#

• You must be allowed to use Discord and follow Discord's Terms of Service and Community Guidelines.
• Only add Ventura to servers where you have the right to do so - usually as the server's owner or an admin acting on their behalf.

Your responsibilities#

• Your server, your content. You're responsible for the content of your server and for what you back up, load or move with Ventura. Loading a backup deletes and replaces content on the server - check the confirmation before you confirm it.
• Your members. Backups contain data of your server's members, e.g. their messages, nicknames and roles. Let your members know that the server is backed up, e.g. in your rules, and point them to the Privacy Policy.
• Transfer codes. Only use transfer codes to move a server's content to servers you control, and only hand them to people you trust. Whoever has a valid code can load that backup onto their server.
• Permissions. Ventura needs Administrator permission to restore a server. Whoever you allow to use /backup on your server acts on it with Ventura's permissions - within the limits Ventura sets (e.g. only the server owner can load and delete backups).

What's not allowed#

• Using Ventura to copy, collect or publish other people's content or data without the right to do so, or to harass, impersonate or harm anyone.
• Using Ventura in violation of Discord's terms or applicable law.
• Attacking, overloading or trying to break Ventura, bypassing its limits (e.g. by adding it to many servers to get around them), or trying to access backups of other servers.

We may stop Ventura from working on a server, remove it from servers, or exclude users if these terms are violated or if it's needed to protect the service, other users or third parties.

Availability and backups#

• We work hard to keep Ventura running and your backups safe, but we can't guarantee that the bot is always available, that every backup succeeds or that every backup can be restored completely. Discord's interface limits what can be backed up and restored; the guide lists what's known.
• Ventura shows what couldn't be backed up or restored in each result. Check it - especially before relying on a backup.

Liability#

• We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and where liability is mandatory by law (e.g. under the German Product Liability Act).
• As Ventura is provided free of charge, we are otherwise not liable - in particular not for lost data, lost backups, or damage caused by using or being unable to use the bot.

Ending the use#

• You can stop using Ventura at any time by removing it from your server. Its backups are deleted 7 days later; server owners can also delete them right away with /backup delete.
• We can end the service, or the service for a server, at any time; where possible, we'll announce it in advance so you can make other arrangements.

Changes to these terms#

We may change these terms, e.g. when Ventura's features change. The date at the top shows when they were last changed. Continuing to use Ventura after a change means you accept the new terms.

Law and jurisdiction#

These terms are governed by the law of the Federal Republic of Germany. If you are a consumer, this choice of law doesn't take away the protection of mandatory provisions of the law of the country where you live. If you are a merchant, the place of jurisdiction is Hamburg, Germany.

If a provision of these terms is invalid, the rest remain in effect.
